CHONGKHAM, FEB 28: A man identified as Lukhi Bijoy who sexually assaulted a minor girl identified as Poranbi Chakma (name changed), daughter of Paranya Chakma of Chakma village-I under Chongkham circle in Namsai district of Arunachal Pradesh.
Recently, the victim’s father reported the matter to the village panchayat, which referred the matter to the Chongkham police outpost for action.
The victim’s father had to withdraw the complaint/FIR on 26 February 2018. Even a reading of the case withdrawal letter show that the sexual assault incident against the minor girl had occurred. In the letter, the victim’s father mentioned that he was withdrawing the FIR as he was satisfied with the warning given by the police officer to the accused not to repeat such incident in the future. The victim’s father also mentioned in the letter that he do not want to proceed with the complaint as he belongs to a poor family.
The victim girl is about 11 years old and she was sexually assaulted about six months ago by the accused Lukhi Bijoy Chakma which age is about 55. However, the victim and her family did not report the incident due to fear after the accused warned of dire consequences.
However, the police did not take action on the complaint. No investigation was conducted and in fact the case was closed despite the victim a minor and a case is clearly made out under the provision of POCSO and various sections under IPC.
Clearly, the contents of the complaint withdrawal letter prima facie show that a case is made out against the accused and it was incumbent on the police officials to investigate the matter and provide justice to the victim as per law.
